Which WTO agreement protects undisclosed business information, including trade secrets?

The story behind the answer

The TRIPS Agreement protects undisclosed business information, including trade secrets.

TRIPS is the WTO’s Agreement on Trade-Related Aspects of Intellectual Property Rights. Article 39 requires members to protect qualifying undisclosed information against unauthorized acquisition, use or disclosure in a way contrary to honest commercial practices. The information must generally be secret, commercially valuable because it is secret, and subject to reasonable steps to keep it secret.

TRIPS covers more than trade secrets. It also sets minimum standards for copyright, trademarks, geographical indications, patents, industrial designs and enforcement procedures. It does not create one worldwide intellectual-property office; each member implements the obligations through its own legal system.
